ACE DuraFlo, Nu Flow Settle Out Of Court
Nu Flow and its installers
to cease “patented” references.
Epoxy pipe lining manufacturer ACE DuraFlo® Systems LLC has settled its lawsuit against Nu Flow Technologies Inc. out of court. ACE sued Nu Flow under the federal patent false marking statute and for false advertising.
As part of the settlement of the action, Nu Flow and its installers will no longer use the terms “patented harness” or “patented cutter.” Nu Flow further agreed to cease using the phrase “holds many patents” until the U.S. Patent and Trademark Office issues a third patent Nu Flow has pending.
With these provisions settled, ACE has abandoned its claim for money damages.
