U.S. District Court Judge Allen Sharp, for the Northern District of Indiana, South Bend Division, gave final approval to the settlement of a class-action suit against Easy Heat Inc. (Klabo v. Easy Heat Inc., Civil Action No. 02-CV-877), which will pay $10 million to consumers in North Dakota, Minnesota and Wisconsin who had purchased allegedly defective XDETS radiant heating cable used in infloor radiant heating systems.
Under the settlement, individual class members may receive lump-sum payments up to $2,500, or be provided with an alternative heating system paid for by Easy Heat along with compensation for the disruption of their home or business and the use of different heating source.
