The death tax, which will slowly phase out until 2010,will return in 2011 at the high tax level of 55 percent since the Senate recently voted not to permanently repeal the tax (57-41 vote). Industry associations have come out strongly against the tax for many years, since its continuously changing tax rate makes transitioning family businesses through generations a complex problem.
