The National Association of Regulatory Utility Commissioners (NARUC) released a draft report noting utilities, small business advocates and ratepayers agree that codes f conduct should provide utility commissions' access to utility and affiliate books and records, and prohibit utility/affiliate joint marketing campaigns.

The report, Codes of Conduct Governing Competitive Market Developments in the Energy Industry: An Analysis of Regulatory Actions, analyzes several issues concerning codes of conduct, including their origin (state public utility commission orders vs. enacted legislation), and common elements.
